Reservations in Promotions : Govt. plans to introduce in the Rajya Sabha on 5 Sept, 2012
The government will introduce the bill to allow reservation in promotions for Scheduled Castes and Scheduled Tribes in government jobs in the Rajya Sabha tomorrow. The Union Cabinet today cleared the proposal today that seeks to amend four key articles of the Constitution to make that possible. promotionIt has to be seen how the BJP allows the functioning of the house as they have not allowed either House to function for the last 10 days demanding the Prime Minister's resignation in connection with a coal scandal. The party however supports the reservation-in-promotions bill. The bill will need the support of a two-thirds majority in both Houses of Parliament and in presence of at least half the total member as it seeks to amend the Constitution. The Samajwadi Party is against the bill. SP had openly aired its displeasure in the all party meet held by the Prime Minister in August regarding the constitutional amendment for promotion on the basis of quota as they were vehemently demanding the inclusion of the OBC’s in the proposal. The There are only three days left of the current monsoon session.

If the government can get the bill passed in the Rajya Sabha tomorrow, it plans to bring it in the Lok Sabha on Thursday. 

Though the amendments are aimed at legally combating any challenge, the bill might still run into rough weather in the courts. Constitutional expert PP Rao said that if the government brings in amendment without "curing the defects" pointed out by the Supreme Court then it may not stand legal scrutiny.
