Sub: Implementation of decision taken in the National Council (JCM) Meeting held on 26/06/2021 and appeal to withdraw the Essential Defence Services Ordinance 2021
Dear Sir,
The issue of the impact of Govt. decision on Corporatising the 41 Ordnance Factories and splintering the same in to 7 Corporations were discussed in the National Council (JCM) meeting held under your Chairmanship on 26/06/2021 The Staff side have unanimously demanded to withdraw the decision taken to Corporatise the 220 years old 41 Ordnance Factories in to 7 Corporations and have also requested to hold discussions with the Federations of Defence Civilian Employees to sort out the issue. After discussion you have directed Secretary (DP) to start negotiations with the Defence Employees Federations. In the meantime it is very much shocking to note that the Govt. of India has promulgated the Essential Defence Services Ordinance 2021 banning the strike in Defence Industry and also incorporating the provisions to take stringent actions against the employees calling the strike and participating in the strike. Any employee can be dismissed according to EDSO-2021 without even conducting an Inquiry. This is a clear violation of the constitutional protection available to the Central Govt. Employees as industrial workers, the legal rights available in the Industrial Dispute Act 1947. The committed and devoted employees of Ordnance Factories doesn’t deserve such a in human treatment from the Govt. of India.
The Industrial Dispute raised by the Federations of the Defence Civilian Employees can be settled through negotiations and discussions instead of resorting to any draconian action like EDSO-2021 etc. Therefore we request your kind intervention in the matter and as decided in the National Council (JCM) negotiations may start with the Federations of Defence Civilian Employees, so that a mutually agreed settlement can be reached in the interest of Narmonious industrial relations and also to avoid any confrontation between the Govt employees and the Government.
