Army pension row: SC pulls up Centre for 'dragging' retired personnel to court, asks frame a policy

The Supreme Court on Thursday (January 30, 2025) criticized the central government for taking retired army personnel to court and asked it to make a proper policy on this issue.

A bench of Justices Abhay S. Oka and Ujjal Bhuyan said that every soldier who gets disability pension from the Armed Forces Tribunal should not be forced to fight in the Supreme Court. The government should use good judgment before filing such cases.

"There should be a practical approach. A soldier serves for 15-20 years, and if they get a disability, the tribunal orders a disability pension. Why should they be forced to come to the Supreme Court?" the bench asked.

The judges said the Union government must create a policy and carefully check before dragging soldiers to court. The Supreme Court also said that filing unnecessary appeals lowers the morale of the armed forces.

The bench warned the government, saying, "Tell us if you will make a policy. If not, we will start imposing heavy fines on such unnecessary appeals."

The case was about the government challenging a tribunal order that granted disability pension to a retired radio fitter.
