Madras HC cites dismissal of employee with 22 years of service illegal

In order to help a mazdoor who had worked for the state health department for over 22 years, the Madras high court overturned his termination order, which had been issued for allegedly hiding facts while getting the position on humanitarian grounds in 1986.

Nagaraj did not divulge that his brother worked for the government while he was seeking employment on compassionate grounds.

Nagaraj filed an appeal with the Supreme Court, challenging the termination judgment of August 4, 2008. During the pendency of the petition, Nagaraj died, and his wife and children were impleaded as parties to the petition.

On January 21, 2020, a single judge of the court granted his request and revoked the termination decision.

The state, enraged, has filed this appeal against the solitary judge's decision.

The sole judge ruled that firing a person after 22 years of service is illegitimate and arbitrary in light of the Supreme Court's decision in Union of India vs. KP Tiwari.

Concurring with the single judge's findings, a division bench comprising Justice S Vaidyanathan and Justice Mohammed Shaffiq upheld the single judge's order.
