Autonomous body employees can't claim same benefits as govt employees: SC

 

The Supreme Court stated that employees of autonomous bodies cannot claim the same service benefits as government employees as a matter of right.

The employees of the Autonomous Board/Body are regulated by their own Service Rules and service conditions, the bench of Justices MR Shah and BV Nagarathna stated in a judgement handed down on Monday.

The court further stated that judicial intervention in a policy choice with financial ramifications and/or a cascade effect is neither needed or justifiable.

The Bombay High Court ordered the State Government to grant pensionary benefits to employees of the Water and Land Management Institute after admitting writ petitions filed by select employees.

The current appeals have been preferred by the state of Maharashtra and others. The State filed an appeal with the Supreme Court, arguing that there is no provision for pension/pensionary benefits under the Service Rules that apply to WALMI personnel.

 It was further contended that the Pension Rules applicable to the State Government employees shall not be made applicable to the employees of WALMI and therefore they are not entitled to the pensionary benefits.
